The Federal Court's decision orders the updating of salaries for staff at national universities and the amounts allocated to student scholarships.

The Federal Administrative Court upheld the lower court's ruling on the injunction that compels the National Executive Branch to immediately comply with Articles 5 and 6 of Law 27.795 on University Funding. This law mandates the adjustment and updating of salaries for teaching and non-teaching staff, as well as the strengthening of student scholarship programs.

The decision of the National Justice system upholds the claim of the National Interuniversity Council (CIN) which requires compliance with the University Financing Law.

The Rector of the Universidad Nacional de Rosario (UNR) and president of the CIN, Franco Bartolacci, expressed: “This is great news. An extremely relevant decision for the country's university community, which we value in a delicate context like the one we are going through. What remains is for the government to comply with the court order.”

“We have been very firm, responsible, and serious throughout this complex time for the university and scientific system. We have always prioritized institutional channels to claim the minimum and essential resources that the system requires to function, and we have exhausted all possible actions to find solutions. This is a very clear court ruling in its reasoning, which ratifies the arguments we have presented. It is a reasonable law that does not place a fiscal burden on the State and safeguards the right to access higher education. This ruling not only reflects the demands of the country's university community but also of society as a whole. Now the National Government must provide the answers, complying with what the law stipulates and what the court has ordered,” he added.

The legal conflict arose following Decree 759/25, through which the Executive Branch sought to suspend the implementation of the Financing Law, citing a lack of specific budget allocations. In response, the National Interuniversity Council (CIN), with active participation from the National University of Rosario (UNR), filed a collective injunction to defend the right to education and the livelihoods of the workers.

The Court emphasized in its ruling that: The law was passed after both houses of Congress insisted by a two-thirds vote, which gives the Executive Branch a binding mandate. Wage losses relative to inflation violate labor rights protected by the National Constitution and International Treaties. The fiscal impact of the measure is only 0,23% of GDP, a figure that does not jeopardize the nation's macroeconomic stability.

With this resolution, it is expected that the National Government will proceed with the immediate updating of salaries and the regularization of the budgets for the operation of the 57 public universities in the country.
